Terms of Service

Welcome to PantryOS™. By accessing or using the PantryOS application ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Service Provider

PantryOS is operated by PMERIT TECHNOLOGIES LLC, a Maine limited liability company and wholly-owned subsidiary of PMERIT (PEOPLE MERIT) LLC.

2. Description of Service

PantryOS is a pantry management application that helps users track food inventory, manage shopping lists, reduce waste, and discover recipes. The Service is available as a Progressive Web App (PWA) at pantryos.pmerit.com.

3. Free and Premium Tiers

Free Tier: Core pantry features operate entirely on your device using local browser storage. No account is required. Free features include pantry tracking, expiry alerts, shopping lists, store deep links, barcode scanning, and offline access.

Premium Tier: Additional features require a registered account and paid subscription. Premium features include cloud sync across devices, AI-powered recipe suggestions, household sharing, voice assistant, and price intelligence. Premium pricing is displayed at the time of subscription.

4. Account Registration

To access premium features, you must create an account with a valid email address and password. You are responsible for:

• Providing accurate registration information
• Maintaining the security of your account credentials
• All activity that occurs under your account

You must be at least 13 years of age to create an account. If you are under 18, you must have parental or guardian consent.

5. Subscriptions and Payments

Premium subscriptions are billed on a recurring basis (monthly or annually) through our payment processor, Stripe. By subscribing, you authorize recurring charges to your payment method.

• Billing: You will be charged at the beginning of each billing period.
• Cancellation: You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period. You retain access to premium features until the period ends.
• Refunds: Refund requests within 7 days of initial subscription or renewal will be considered on a case-by-case basis. Contact us at [email protected].
• Price Changes: We may change pricing with 30 days advance notice. Continued use after a price change constitutes acceptance.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse engineer, decompile, or extract the source code
• Interfere with the Service's operation or security
• Create multiple accounts to circumvent usage limits
• Use automated means to access the Service (bots, scrapers)
• Resell or redistribute the Service

7. Intellectual Property

PantryOS™ and PMERIT™ are trademarks of PMERIT (PEOPLE MERIT) LLC. All content, code, design, and features of the Service are the proprietary property of PMERIT TECHNOLOGIES LLC and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any data you enter into PantryOS (pantry items, shopping lists, etc.).

8. Data and Local Storage

Free-tier data is stored exclusively in your browser's local storage on your device. We do not have access to, and cannot recover, locally stored data. Clearing your browser data will permanently delete your local PantryOS data.

Premium users' data is synced to our cloud infrastructure (Cloudflare D1). See our Privacy Policy for details on data handling.

9. Affiliate Links

PantryOS may include links to third-party retailers (such as Walmart, Amazon, and Target). Some links may contain affiliate tracking parameters. If you make a purchase through these links, PMERIT Technologies may earn a commission at no additional cost to you. Affiliate relationships do not influence product recommendations or search results.

10. Third-Party Services

The Service integrates with third-party services including Stripe (payments), barcode databases, and AI language models. These services have their own terms and privacy policies. We are not responsible for third-party service availability or conduct.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that the Service will be uninterrupted, error-free, or secure. Nutritional information, recipe suggestions, and expiry estimates are informational only and should not replace professional dietary or food safety advice.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PMERIT TECHNOLOGIES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

13. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination, your premium features will cease and cloud-synced data will be deleted within 30 days.

14. Changes to These Terms

We may update these Terms at any time. Material changes will be communicated via the email associated with your account or through an in-app notice. Continued use after changes take effect constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the State of Maine, United States. Any disputes shall be resolved in the courts of Aroostook County, Maine.
